In minutes, jury convicts Fla. man of girl’s rape, murder

JACKSONVILLE, Fla. — It took a jury 14 mins Wednesday to crook a 61-year-old Florida man of abducting, raping and murdering 8-year-old Cherish Perrywinkle, CBS associate WJAX reports. He now faces a probable death sentence.

The Jacksonville courtroom had just left into recess after the judge review instructions to the jurors when everybody fast returned. A decision was in: unanimous guilty verdicts against Donald Smith in the crimes against Cherish Perrywinkle.

The white-haired Smith, wearing shirt and plaid tie, watched but countenance as the jury director fast review by the verdicts. 

Cherish was abducted from a Walmart in 2013 after Smith persuaded her mother that he would buy the bad family some garments with a present card. 

Smith had introduced himself as a good Samaritan to the mother, Rayne Perrywinkle, at a bonus store progressing in the day, observant his wife would meet them at the Walmart and bring the card. 

The wife never showed up, and Smith instead lured Cherish divided from her mom and two sisters as they shopped. It got late, and Rayne pronounced she hadn’t fed the girls, so Smith offering to go to a McDonald’s located in the front of the store and get them some cheeseburgers.

Cherish followed Smith by the store. The McDonald’s was closed, and notice footage showed the girl following Smith out of the store and getting into his white van.

“To the untrained eye he looks like Uncle Joe who is selling with Rayne and the kids,” prosecutor Mark Caliel pronounced during his shutting evidence Wednesday morning.

“He done her feel protected by his lies and deception,” Caliel said. “And then he preyed on her. He gathering her out of that parking lot of the Walmart to where no eyes could see and no ears could hear.”

After about 20 mins Rayne testified that she satisfied something was wrong. She didn’t have a operative cellphone, so she borrowed one from a Walmart employee and called 911.

By then it was too late. Cherish’s smashed physique was found in a Jacksonville creek, still ornate in the orange dress with a fruit print. When police arrested Smith his pants were wet. Later, technicians found his DNA all over her body.

The jury was shown hideous photographs of Cherish’s body. While testifying about the girl’s injuries the city’s arch medical examiner had to miscarry her testimony since she became too romantic while articulate about it. Multiple jurors also cried, covered their mouths and incited divided as the striking photos were shown, CBS associate WJAX’s Bridgette Matter reported around Twitter.

Caliel told the jurors they would never forget the images they were forced to see.

“They will perpetually be a partial of your memory. Burned into your memory,” he said.

The jury was systematic to return to justice Tuesday to start the chastisement proviso of the trial. Smith faces a probable death sentence. He was convicted of first-degree murder, abduction and passionate battery on a child reduction than 12 years of age.
